Recruitment Privacy Policy

  1. Purpose
    • WPS is committed to providing quality services and safeguarding your personal information, including sensitive data such as medical information. This Privacy Policy outlines how we manage your personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
    • A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Australian Information Commissioner at the OAIC website.
  2. What is Personal Information and why do we collect it?
    • Personal Information is information or an opinion that identifies an individual. This may include, but is not limited to, names, addresses, phone numbers, email addresses, and employment-related details.
    • We may collect your personal information in various ways, including through direct interactions, correspondence, telephone or email communications, from publicly available sources, and through third parties. However, we do not guarantee the policies of third parties or external websites linked through our services.
    • We collect your Personal Information for the primary purpose of recruitment and your employment. We may also use your Personal Information for secondary purposes such as internal communications, processing benefits, or fulfilling legal obligations.
  3. Sensitive Information
    • Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
    • Medical information is classed as sensitive information. This can include details about an individual’s physical or mental health, medical conditions, treatment, or history.
    • Sensitive or medical information will be used by WPS in the following circumstances:
    • for the primary purpose for which it was collected, such as managing workplace injury, illness, or disability,
    • for a secondary purpose that is directly related to the primary purpose,
    • with your explicit consent, or
    • where required or authorised by law.
  4. Third Parties
    • Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances information may be obtained from third parties, such as recruitment agencies or medical providers.
    • Should we obtain medical information from third parties (e.g., healthcare providers or insurers), we will take reasonable steps to ensure that you are aware of the information being provided to us. This includes ensuring that such information is collected, used, and disclosed in compliance with applicable privacy laws.
  5. Disclosure of Personal Information
    • Your Personal Information may be disclosed under the following circumstances:
      • Where you have provided your consent to the use or disclosure of your information, and
      • Where required or authorised by law (e.g., for regulatory or legal purposes, including complying with workers’ compensation or work health and safety requirements).
      • In certain cases, personal information may also be shared with third-party service providers (e.g., medical professionals, IT services, payroll providers), and we ensure these parties adhere to confidentiality and privacy requirements.
  6. Security of Personal Information
    • We are committed to protecting your Personal Information, including medical information, from misuse, loss, unauthorised access, modification, or disclosure. We implement reasonable and appropriate physical, technical, and administrative safeguards to protect your data.
    • When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information.

    • You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
    • In order to protect your Personal Information we may require identification from you before releasing the requested information.
    • There may be instances where access to your personal information, including medical information, is restricted, such as in situations where providing access would pose a threat to the safety of an individual or if legally prohibited.
  8. Maintaining the Quality of your Personal Information
    • We aim to ensure that the personal information we hold, including medical information, is accurate, complete, and up to date. If you believe any of the information, we have is incorrect, please notify us as soon as practicable so we can update our records.
